Terms of Service

Last updated: 5 October 2026

Operator: Indefatigable ICU

By playing the game (“the Service”) you agree to these terms. If you do not agree, do not use the Service. This is a free, non-commercial fan project.

1. Eligibility

You must be at least 13 years old to use the Service, and old enough to consent to data processing in your jurisdiction. By confirming your age at the title screen and entering the game, you represent that you meet this requirement. The Service is not directed to children under 13.

2. Accounts

You may play as a guest on one device or sign in with Google. You are responsible for activity under your account and for keeping your Google account secure. We may suspend identities that abuse the Service (see §3) or disrupt other players.

3. Acceptable use

You agree not to:

4. User content

“User content” means the small records you submit through normal gameplay (for example your soul name and the book-submission record described in the Privacy Policy). You keep ownership of your content. You grant us a non-exclusive, worldwide, royalty-free licence to store, display, and review that content as needed to operate the Service (such as showing submissions in the admin console). You must not submit content you do not have the right to share.

5. Intellectual property

A Short Stay in Hell is a novel by Steven L. Peck; its story, characters, and text remain the property of the author and are used here without modification beyond short quotations for reference. “Borges” references refer to the work of Jorge Luis Borges. The game’s code, 3D assets, and original visual design are the property of the project’s developers. This is an unofficial, non-commercial fan work; it is not endorsed by or affiliated with the author or his publishers.

6. Virtual items

The Service charges no fees and sells no virtual goods. Books, food, and beds in the library are game objects with no monetary value and cannot be exchanged for money or anything of value.

7. No warranty

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted availability; saves, multiplayer sessions, or records may be lost if systems fail.

8. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Because the Service is provided completely free of charge, our total maximum liability for any claim relating to the Service is strictly limited to $0. Nothing in these terms limits liability that cannot be limited by law.

9. Indemnity

You agree to indemnify us against claims arising from your misuse of the Service or your violation of these terms, to the extent permitted by law.

10. Termination

You may stop using the Service at any time (clearing site data removes your local profile). We may suspend or terminate access for material or repeated violations of §3, and may discontinue the Service entirely at any time, with reasonable notice where practicable.

11. Changes

We may update these terms. The “Last updated” date above will change when we do; material changes will be announced on the title screen. Continued use after changes take effect constitutes acceptance of the revised terms.

12. Governing law

These terms are governed by the law applicable at the operator’s principal place of business, without regard to conflict-of-law rules; nothing in these terms deprives you of the mandatory protections of the law of your country of residence. If any provision is found unenforceable, the remaining provisions stay in effect.
